Agreements are concluded between you and ThaleiaDesign. Other information about ThaleiaDesign and its contact details can be found on the website. The terms and conditions apply to consumers who order via our website.

ThaleiaDesign does not accept credit purchases from individuals under 18 years of age. To be able to order on the website, you must therefore be 18 years or older. ThaleiaDesign reserves the right to refuse or modify such orders in individual cases (for example, if you have provided incorrect personal information and/or if we have comments regarding a payment or debt).

ThaleiaDesign is not liable when a product is out of stock, or in the event of image or printing errors on the website, such as errors in technical specifications, product descriptions or incorrect prices and price adjustments (such as changes in supplier prices or currency fluctuations) or incorrect information about whether a product is in stock. ThaleiaDesign is entitled to correct errors and change or update information at any time. If an incorrect price has been calculated for a product you have ordered, ThaleiaDesign will notify you and wait to process the order until you have approved the corrected price. All images on the website are for illustration purposes and do not guarantee the exact appearance of the product.

2. Orders and agreements

To make a purchase through the website, you must accept our general terms and conditions. Once you accept the terms, you agree to comply with and follow these terms in their entirety and you confirm that you have taken note of the information regarding personal data and consent to the use of this personal data and cookies in accordance with ThaleiaDesign's privacy policy.

A purchase agreement is only concluded when ThaleiaDesign has received your order and you have received a confirmation from ThaleiaDesign by e-mail. You can cancel the order until it has been confirmed by ThaleiaDesign. In the event that the order is revoked, ThaleiaDesign will refund all payments made by you or by your payment or credit card company.

ThaleiaDesign is a B2C company and sells to private individuals for purchases via the webshop. We can, of course, provide a payment receipt for all purchased goods, including VAT and the information provided when placing the order.

4. Payments, costs and prices

4.1

For orders placed via our website "www.thaleiadesign.com", the prices stated on the website apply. The prices are stated in euros (€) and include VAT. The stated prices do not include payment and shipping costs; these will be stated separately.

4.2

Our website describes the payment methods you can use. ThaleiaDesign has the right to require prepayment of the order. ThaleiaDesign also has the right to change the chosen payment method if it does not work for any reason at the time you make a purchase. The website states when there are any restrictions on payment options.

5. Offers and promotions

5.1

ThaleiaDesign can offer promotions on the website at any time that may have more favorable conditions than those stated in these terms and conditions, for example regarding payment or the right of withdrawal. These more favorable conditions apply as long as the offer runs and only apply to the specific products and goods mentioned in ThaleiaDesign's promotional campaign. ThaleiaDesign reserves the right to withdraw such promotions at any time. Upon termination or withdrawal of a promotion or offer, these General Terms and Conditions apply without any changes. All offers of specific products on the website are valid within the time stated on the website with the offer and while stocks last.

6. Shipping and delivery

6.1

When goods are in stock, they will be delivered within the period stated on the website. Unless otherwise agreed, delivery will take place within 7 working days after ThaleiaDesign has sent a written confirmation of the order. 6.2

You can find the estimated delivery time in the order confirmation, during checkout and/or on the relevant product page of the products concerned. Unless otherwise agreed and delivery takes more than 30 days, and this is not due to the customer, you have the right to cancel the purchase.

7. Right of withdrawal

7.1

When purchasing products via the website, the statutory 14-day right of withdrawal applies (distance selling). You therefore have the right to cancel the purchase within 14 days from the moment you or the person who received the ordered goods received them. (Withdrawal period).

7.2

If the right of withdrawal does not apply to a product on the website, you will receive clear information about this. If a product is sealed, do not break the seal if you wish to exercise your right of withdrawal.

7.3

If you change your mind before the 14-day cooling-off period has expired, you must notify ThaleiaDesign by email, stating which goods you wish to return or exchange. Send an email to info@thaleiadesign.com and state your name, address, and other relevant information, such as the order number, and the name/names of the products concerned.

7.4

In the event that you exercise your right of withdrawal, the costs of return shipping are for you, and you are also responsible for the condition of the goods when they are returned to us, as well as during the return shipment. From the date of receipt of the goods, you must carefully store the package and notify us that you wish to return it. This can be done via info@thaleiadesign.com stating the subject 'Withdrawal'. You then have 14 days to return the goods to us. The product must be well packaged and in good condition upon arrival and must also be returned in its original box.

7.5

In case of withdrawal, ThaleiaDesign will refund the amount you paid for the item, including delivery costs. Exceptions apply, but generally no additional costs will be charged for the return shipment unless you use a different shipping method than the standard shipping method we, ThaleiaDesign, offer. If you return part of the order, no shipping costs will be refunded. ThaleiaDesign has the right to deduct an amount from the refund, within the prices used for the products concerned, if it is found that a decrease in value has been caused by the customer, because the product has been used, or has been opened unnecessarily to determine functions and properties.

7.6

ThaleiaDesign will refund the amount to the customer without undue delay, within 14 days from the date on which ThaleiaDesign received notification from the customer regarding the right of withdrawal. However, ThaleiaDesign may delay the refund until ThaleiaDesign has received the products concerned back, or until the customer has provided a proof document that the product has been returned. This proof can, for example, be a return receipt from the post office where you delivered the package. The refund will take place using the refund method chosen by the customer, unless otherwise agreed or if an objection has been made to a chosen refund method. When the customer exercises his right to withdraw from his purchase, ThaleiaDesign will refund the amount the customer paid for the product, including shipping costs. In the case of additional shipping costs due to the customer's choice of a different delivery than the standard ThaleiaDesign delivery, only the standard shipping costs will be refunded upon full refund of the order. In the case of a partial return of the order, the shipping costs will not be refunded.

8. Complaints and warranty

8.1

You have a warranty on the products you purchased online through our website. The warranty covers goods that are broken or damaged, as described in the Consumer Protection Enforcement Act. Warranties apply only to original manufacturing defects and not to damage caused during or after receipt of the products due to your own fault. If you have received a damaged product, please contact us as soon as possible after discovering the error by sending us an e-mail with photos of both the damaged goods and any damaged packaging. You can send this e-mail to info@thaleiadesign.com stating the subject 'Warranty'.

8.2

You have the right to file a complaint if products are defective in accordance with applicable consumer protection legislation. If the customer wishes to claim his right to file a complaint for an ordered product, the customer must notify us as soon as possible after discovering the defect by contacting ThaleiaDesign customer service via the contact form on the website or by sending an email to info@thaleiadesign.com stating the subject 'Complaint'.

8.3

ThaleiaDesign is responsible for the costs of return shipping for approved complaints.

8.4

When an item is returned and the complaint is approved, ThaleiaDesign will compensate/reimburse you under applicable consumer protection laws. ThaleiaDesign strives to do this within 14 days after ThaleiaDesign has handled the complaint, but it may take longer, depending on the type of product. ThaleiaDesign reserves the right to reject a claim for damages that is not found to be defective under applicable consumer protection laws. ThaleiaDesign follows the strict guidelines set by the consumer complaints commission when handling complaints or does so according to the guidelines of corresponding authorities.

9. Force Majeure

ThaleiaDesign is not responsible for delays caused by circumstances beyond ThaleiaDesign's control, such as extreme weather conditions, war, fire, general labor disputes, lightning strikes, terrorist attacks, changes in regulations and legislation, technical problems, malfunctions in electrical, telecommunication and/or data connections or other forms of communication, as well as errors, malfunctions or delays in services of suppliers or partners, caused by circumstances as mentioned above. These circumstances constitute exemption from liability, penalties and damages. In the event that such a situation occurs, ThaleiaDesign will inform you, from the beginning to the end of the situation concerned. If the calamities/circumstances continue for longer than two months, both you and ThaleiaDesign have the right to cancel the purchase with immediate effect.

10. Changes to the general terms and conditions

ThaleiaDesign reserves the right to change these terms and conditions at any time. Any changes to these General Terms and Conditions will be published on the website. Any changes will apply from the date on which you accept the General Terms and Conditions (in connection with a purchase or a visit to the website), or 30 days after ThaleiaDesign has informed you of the changes. However, ThaleiaDesign recommends that you visit the website regularly so that you remain informed of all possible changes to the General Terms and Conditions.

11. Invalidity

In the event that any provision within this agreement is declared invalid or unenforceable by a competent court, government agency, or by a court, the remainder of the provision concerned, as well as all other provisions, shall be valid and enforceable to the extent permitted by applicable law. Declared provisions that are invalid or unenforceable will be replaced under relevant legal guidelines and advice.
